Where we decide the purpose and means for the processing of the personal data, we are the 'data controller'. As data controller, we will comply with all applicable data protection laws.

What personal information are we likely to collect about you?

In order to produce and distribute content and undertake other related business activities, we will need to collect and process information about you. Such information may include:

  • your name;
  • your email address;
  • your postal address;
  • your bank details;
  • communications we have had with you, i.e. your emails;
  • if you have an on-screen or voiceover role, images, video, audio of you;
  • if your vehicle appears in our production, your licence plate number;
  • if your property appears in our production, this may also reveal information about you.

Mostly, we collect personal information directly from you. For example, through resumes, identity documents, forms completed by you, correspondence with you or through interviews, auditions, meetings or other assessments, and from you participation in filming.

How do we use your personal data and on what basis?

We need the categories of information listed above:

  • to allow us to perform our contract with you;
  • to enable us to comply with our legal obligations; and
  • to pursue legitimate interests of our own or of third parties to operate our business, provided that your interests and fundamental rights do not override those interests.

Due to the nature of our business, where appropriate and lawful, we may rely upon exemptions to data protection rules in relation to journalistic freedom, the right to artistic expression or more generally, the right to freedom of expression.

  • entering into an agreement with you relating to your or your property' s appearance in our productions;
  • any reasonable checks we may make to verify information provided by you;
  • performance of the terms of the agreement;
  • processing images / video / audio of you or your property;
  • processing payments to you from us, where applicable;
  • recording and managing the ownership and licensing of intellectual property rights, in particular copyright;
  • credit your role.

Tax and other legal obligations

  • implementing health and safety regulation or security measures
  • reporting VAT and other company tax reporting purposes (as required by law)
  • complying with regulators, law enforcement agencies or in relation to any claims that may arise

In accordance with our legal obligations, we may disclose your information to the extent required by law which may include for financial accounting and taxation purposes with our auditors, regulators or other government bodies such as HMRC. We may also disclose your information to third parties in order to enforce or apply our contractual terms, to investigate potential breaches, to protect the rights and freedoms, property or safety of our business or those of our customers and other individuals.

If we are involved in a merger, acquisition, or sale of all or a portion of our business or assets, the information we hold may be included as part of that sale, in which case you will be notified via email and/or a prominent notice on our website of any changes in ownership or use of your information, as any choices you may have regarding that information.

Do we share your personal information with anyone else?

We keep your information confidential, but may disclose it to our personnel, suppliers or subcontractors (including our cloud-based data processing or professional advisors) insofar as it is reasonably necessary for the purposes set out in this Privacy Policy, provided that they do not make independent use of the information and have agreed to adhere to the rules set out in this Privacy Policy. We may share contractual agreements, such as contributor agreements or location agreements, with our production partners (including broadcasters or networks).

If you have an on-screen or voiceover role, we may disclose footage, images, or audio recordings of you as part of the broadcasting, distribution and marketing of the production. We may also disclose your name to allow us to credit your role.

Your choices and rights in relation to personal data which we process relating to you

You have the following rights over the way we process personal data relating to you. We aim to comply without undue delay, and within one month at the latest:

  • to ask for a copy of data we are processing about you and have inaccuracies corrected;
  • to ask us to restrict, stop processing, or to delete your personal data;
  • to request a machine readable copy of your personal data, which you can use with another service provider. Where it is technically feasible, you can ask us to send this information directly to another provider if you prefer; and

Children

We only use information from children under the age of 16 where it is lawful and appropriate to do so. We will always communicate with a parent or guardian in this respect.

Retention

In accordance with data protection laws and good commercial practice, we do not retain data in a form that permits identification of the person(s) to whom it relates for any longer than is necessary. Once the purpose for which information has been collected has been fulfilled, we will either permanently delete your personal information or remove all identifiers within it so that it is no longer personal data. We may use such anonymised data for research and/or business analysis purposes.

International Data Transfers

Our servers are located in the UK and the information that we collect directly from you will be stored in these servers. We may also transfer your personal data to our third party service providers, many of whom may be located outside of the UK or EU, operate from multiple locations including non-UK and non-EU based operations or engage sub-processors located outside the UK or EU.

There are agreements in place with all of our third party service providers to ensure that those parties process personal data using appropriate safeguards that meet the requirements of data protection laws.
